1. General terms and definitions

S.C. MIT CLIMA DISTRIBUTION S.R.Lshall hereinafter be referred to as the Supplier.
The Client may be any natural or legal person who has free access to the website and can authenticate by creating an account in order to place an order.
The site hava-hvac.com is not intended for resellers.
Content means all information on the website that can be viewed via an electronic device; the content of all actions undertaken by the Client towards the Supplier and any other available means of communication.
The Order is an electronic document defined as a means of communication between the Supplier and the Client, used to express the intention to purchase goods from the website.
The Contract is the agreement concluded between the Supplier and the Client.
Use of the website by the visitor implies the tacit and unconditional acceptance of these terms and conditions, with all resulting consequences.
S.C. MIT CLIMA DISTRIBUTION S.R.L reserves the right to make changes and updates to these terms and conditions without prior notice and without specifying the reasons.
The following terms and conditions have contractual value between S.C. MIT CLIMA DISTRIBUTION S.R.Lhereinafter referred to as the Supplier and the Client/Visitor.
The Client/Visitor is advised to read the terms and conditions carefully.
2. Personal data security
In order to enable communication between S.C. MIT CLIMA DISTRIBUTION S.R.L and the Client/Visitorvia the hava-hvac.com website, you must agree that the Supplier may collect and process the data requested from the Client for account creation and authentication, as well as the data entered in the order form, in accordance with Regulation (EU) 2016/679.
The personal data provided to the Supplier will be used only for the stated purpose of this website. They will be used to communicate with the Client, to deliver the products ordered through the website, to respond promptly to inquiries, to generate internal statistics, and to provide information via email or other means of communication regarding future actions, possible promotions, periodic newsletters, etc.
You are required to provide the data, as they are necessary to contact the Supplier. Your refusal will make it impossible to contact you and to provide the requested information and ordered products.
The information received from the Client or Visitor will not be disclosed to any natural or legal person, institution, etc., except where duly requested by competent authorities.
We respect and guarantee the confidentiality of data voluntarily provided by the Client or Visitor.

3. Copyright
All website content – images, photographs, texts, graphics, symbols, web graphic elements, scripts, programs, and other data – is the property of the Supplier and is protected by copyright law and intellectual and industrial property laws. The use, reproduction, copying, or modification without the Supplier’s consent of any of the elements listed above, even if such elements bear protection markings, shall entail the consequences provided by the applicable legislation. Free access to the website and its content and their use are permitted only for personal use, without direct or indirect commercial purpose. Copying, storing, modifying, or transferring, in whole or in part, the website and/or its content is not permitted without the explicit written consent of the Supplier and is sanctioned according to applicable law.
4. Transport damages
If, upon delivery, the Client notices obvious defects in the packaging or the goods, they must report this shortly after receiving the goods.
Upon receiving the goods, the Client must obtain written confirmation from the delivery person regarding any visible transport damages. This does not limit the Client’s legal rights and obligations.
5. Right of return
According to Government Emergency Ordinance no. 34/2014,for individuals purchasing products from websites using distance communication techniques:
“The consumer has the right to unilaterally withdraw from the distance contract, without penalties and without providing a reason, within 14 days from receiving the product or, in the case of services, from the conclusion of the contract. The only costs that may be borne by the consumer are the direct costs of returning the products.”
It is the Client’s responsibility to ensure that the products referred to are returned within a maximum of 14 days from the date of notification.
The refund of the product value may be postponed if S.C. MIT CLIMA DISTRIBUTION
S.R.L has not received the returned product nor proof that it has been sent (whichever occurs first) within a maximum of 14 days from notifying S.C. MIT CLIMA DISTRIBUTION S.R.L of your decision to withdraw from the contract.
6. Product warranty
Warranty conditions comply with Directive 1999/44/EC. The Supplier’s products are guaranteed for a period of 24 months from the date of delivery.
When requesting warranty service, it is necessary to present/send the defective product, together with its accessories, to the Supplier’s headquarters, in the original packaging, along with a copy of the invoice proving purchase. Failure to comply may result in the products being returned without resolving the warranty claim.
The transport costs for sending the defective product will be fully covered by the Supplier (for products covered by the manufacturer’s warranty).
To preserve the quality characteristics of the products, you must follow the maintenance recommendations according to the symbols on the product label. Any violation leads to the cancellation of the warranty.
The above-mentioned warranty does not apply in the case of defects attributable to the Client, such as:
– defects caused by the Client as a result of using the products for purposes other than those for which they were manufactured/sold.
– negligent handling and use of the products, or when the products have come into contact with substances not required in the process of use/installation.
– interventions on the products, regardless of their nature, carried out without the Supplier’s written consent.
– defects caused by transport under the Client’s responsibility, improper handling or storage by the Client.
– the Supplier is also exempt from the obligation to provide warranty if it is found that the beneficiary of the repair carried out by the Client has used the product improperly.
7. Force majeure
Force majeure exempts the invoking party from liability, in accordance with the provisions of the Civil Code (art. 1351 NCC). Force majeure is any external, unforeseeable, absolutely invincible and unavoidable event, while a fortuitous event is one that cannot be foreseen or prevented by the person who would have been liable if the event had not occurred.
The party invoking force majeure must notify the other party in writing within a maximum of 5 (five) days from its occurrence, and proof of force majeure must be communicated within 15 (fifteen) days from its occurrence. The reference date is the date of the postal dispatch stamp. Proof shall be certified by the Chamber of Commerce and Industry or another body authorized under Romanian law. The party invoking force majeure must notify the other party of its cessation within a maximum of 15 (fifteen) days from its end.
8. Disputes
Any dispute between the Client and the Supplier shall be settled amicably by agreement between the two parties. If this is not possible, jurisdiction lies with the Romanian courts, specifically the court having territorial jurisdiction over the registered office of S.C. MIT CLIMA DISTRIBUTION S.R.L.
9. Final provisions
The Supplier reserves the right to make any changes to these provisions, as well as any changes to the Website, its structure, or any other changes that may affect the Website, without prior notification to the Visitor or Client.
The Supplier shall not be held responsible for any errors occurring on the Website for any reason, including due to changes or settings not made by the Website administrator.
